General Terms and Conditions of Sale

• General

The following terms and conditions of sale govern all purchases of products from adamsBlatt.com and evasBlatt.com. Every time you make a purchase on our site, you acknowledge and accept these terms and conditions of sale.

• Offer

All offers apply witthout obligation. Slight deviations and technical changes to our descriptions are possible.

All prices on this site are subject to change at any time without notice. 

In case of unintentional or obvious write and calculation errors Eric Barré Ltd. is entitled to resignation. 

Eric Barré Ltd. is furthermore entitled to reject orders or - in case of supply difficulties - not to execute orders.

• Prices

All indicated prices are net and include Swiss V.A.T. 

All prices on this site are subject to change without notice. 

All international deliveries are taxfree. However, when shipping abroad the customer may be charged with any additional taxes and duties. Ask your local custom office for detailed information.

• Minimal Order

There is no minimal order.

• Shipping and Delivery

The items are shipped by Swiss post to any address in Switzerland or abroad. 

The customer is bound to receive the goods and pay them.

When shipping abroad the customer may be charged with any additional taxes and duties.

Deliveries are made alternatively after authorizing the payment by credit card (MasterCard/Visa), prepayment or with cash on delivery (please consider additional fees). 

Within Switzerland we also ship with invoice.

Any costs of a return, which are based on an incorrect or incomplete addressing, or due to a non-acceptance of the customer have may be charged to the customer.

• Delivery Time

All orders will be executed within 48h unless otherwise indicated. If however we are out of stock, the customer will be informed by email.

• Payment

Payment of the product prices and relevant shipping costs must be made by using one of the procedures indicated on the order form.

• Invoice: Payment in full to DeCours GmbH shall be effected no later than 10 days from the date of invoice by the method of payment specified.
• Credit card: The price for the purchase of products and the relevant shipping costs, as indicated in the order form, will be charged to your current account only when the purchased products are actually delivered.

In case of payment by credit card, all details (for example, card number or expiration date) will be sent by encrypted protocol to Royal Bank of Scotland's electronic payment service, without third parties having any access thereto whatsoever. Such details will not be used by DeCours GmbH except for performing the procedure relevant to your purchase or issuing relevant refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases or frauds to the police.

If the customer comes into delay of payment, Eric Barré Ltd. is entitled to charge an expenditure remuneration of CHF 10.-/EUR 7. -.

• Returns and Exchange

If any customer is dissatisfied with the goods that they have purchased, we will offer a 100% refund or exchange (excluding individual print, delivery charge and gift-wrapping).

Only un-worn garments in their original packaging (including hang tags) can be returned or exchanged. Both the goods and the packaging have to be in a re-saleable condition to qualify for a refund. This return policy does not apply where the packaging has been damaged or the goods worn, for hygiene reasons we are unable to accept a returned garment, unless there is a fault with the goods, in which case we will offer a 100% refund including any delivery charge.

Returns must be received back into the warehouse within ten (10) working days of receipt of the products purchased.

When returning goods please ensure that the return packaging is of adequate quality to ensure the safe arrival of the item. Please include a copy of the bill and send all to the following address:

Shipping charges are not refundable except in the case where the products do not have the promised essential characteristics, have manufacturing defects or they have been erroneously delivered. 

In the event that your return does not comply with the terms and conditions set above, you will not be entitled to any refund of sums already paid to DeCours GmbH; nevertheless, you shall be entitled, at your own expense, to receive the products in the conditions in which they were sent back to DeCours GmbH. If you do not wish to receive the products in the conditions in which they were sent back to Eric Barré Ltd., the company shall be entitled to keep the products and withhold the sums already received.

• Refunds

If the return right is exercised in conformity with the provisions, Eric Barré Ltd. shall refund the sums paid for the returned products, net of any shipping costs for the delivery to you of the purchased products.  

Whatever the term of payment used by you, the refund procedure shall be started by Eric Barré Ltd. within ten (10) days of receipt of the products returned, after checking that the return right has been correctly exercised and that the returned products are accepted.

The time period for refunding the sums you paid for purchasing the products depends on the terms of payment used:

• purchase by credit card for purchasing products, the time period depends on the credit card, but the money is normally refunded after two bank statements have been issued. Please note that the currency exchange rate to be used for refunding the sums paid is the same as the currency exchange rate at the date of debit on your current account; consequently you will not be penalised in terms of bank interest.
• payment made by cash on delivery: you will be refunded the sums you paid for purchasing products on your current account; the time needed for refunds depends on data you provided in your order; normally refunds take place within a month.

• Guarantee

If the customer supplies evidence for defects in delivered goods, we will provide the removal of the defects or a substitute delivery within a reasonable time. Should we not succeed in doing so, the customer may cancel the purchase or have a price reduction.

Excluded from guarantee are defects and interference which are beyond our influence, such as natural wear and tear, improper use, interference of the customer or third party, excessive strain or extreme influence of the environment.

• Property

All items remain the property of Eric Barré Ltd. until full payment has been received from the customer.

• Governing Law

These general terms and conditions of sale are governed by Swiss law.

Swiss Law is applied exclusively, also when orders are placed from abroad or goods delivered abroad. 

Jurisdiction place are the courts of Zurich, Switzerland.
